Abstract

Los Vientres de Alquiler son un debate candente en nuestra sociedad. La práctica, prohibida en nuestro país, prolifera fuera de nuestras fronteras lo que se traduce en un turismo gestacional que abre todavía más la brecha entre los que tienen recursos y los que no. Este hecho se ha convertido en un grave problema en nuestro país y precisa de una profunda reflexión acerca de las connotaciones éticas, sociales y económicas que surgen de esta práctica. El presente trabajo tratará de esclarecer si los Vientres de Alquiler respetan la dignidad humana que representa el límite de nuestros derechos. Para ello se analizará el concepto de libertad enmarcado en el contexto socio-político y si este es suficiente para legitimar la satisfacción de cualquier deseo. El análisis de los argumentos a favor y en contra de la práctica servirá para dilucidar si es posible una legislación que la permita o si por el contrario deberemos regular la prohibición de ésta. Además deberemos encontrar alguna solución para el problema transfronterizo que ha surgido al permitir la inscripción en el Registro Civil de los menores gestados fuera de nuestros países y la problemática que se presenta al tener que reconocer la filiación. Por último se propondrá un modelo garantista que trate de respetar los derechos, la libertad y la dignidad de todos los afectados en la práctica, en especial los más débiles, tratando de encontrar un punto intermedio en el debate polarizado.

Rental Bellies are a highly topical debate in our society. The practice, that is not allowed in our country, proliferates outside our borders, which translates into gestational tourism that opens the gap between those who have resources and those who do not. This fact has become in a serious problem in our country and requires a deep reflection about the ethical, social and economic connotations that arisen from this practice. The present work will try to clarify if the rent bellies respect the human dignity that represents the limit of our rights. For this, we will analyze the concept of freedom into the socio-political context and if this concept will be sufficient to legitimize the satisfaction of any desire. The analysis of the arguments in pro and against the practice will serve to elucidate if it is possible a legislation that allows it or, contrary we will have to regulate the prohibition of this one. We must also find a solution to the cross-border problem that has arisen by allowing the registration in the Civil Registry of children born outside our countries and the problem that arises when having to recognize the affiliation. Finally, a guarantee model will be proposed that seeks to respect the rights, freedom and dignity of all those affected in practice, especially the weakest, trying to find an intermediate point in the polarized debate.
