El derecho humano a la privacidad desde el enfoque de las capacidades: una reflexión educativa

Abstract

En un mundo repleto de aplicaciones que instan a la constante publicación de nuestra vida personal, el derecho a la privacidad está indudablemente en riesgo. Este trabajo, desde una perspectiva filosófico-educativa y, por tanto, fundamentalmente a través del análisis crítico de textos, pretende averiguar hasta qué punto este derecho es vulnerado en nuestra sociedad occidental actual. Para ello seguiremos el enfoque de las capacidades, pues nos permite realizar un análisis sumamente detallado de la realidad social. En primer lugar, mostraremos la importancia del derecho humano a la privacidad. En segundo, analizaremos su cumplimiento en la sociedad actual sobre todo en lo que respecta a nativos digitales . En tercero, aportaremos algunas estrategias educativas que pueden ayudar para su mantenimiento y extensión. En cuarto y último lugar demostraremos la necesidad de una pedagogía de la desconexión temporal, si lo que queremos es proteger el derecho humano a la privacidad.

In a world full of applications that urge to the continuous publication of our personal life, the right to privacy is undoubtedly on risk. From a philosophicaleducational perspective, and thus fundamentally by means of critical analysis of texts, this paper sets out to look into what extent this right is infringed in our current Western society. Given that it allows us for doing a strongly detailed analysis of the social reality, for this purpose we will take the Capability Approach. First, we will show the importance of the human right to privacy. Second, we will analyze its observance in the current society regarding digital natives above all . Third, we will provide some educational strategies which can help in its maintenance and spreading. Finally, we will conclude the necessity of pedagogy for temporary disconnection if what we want is to protect the human right to privacy.
