ABSTRACT From early period of Islamic history to current days, individuals have been resort to muftis for solving problems that related to religious issues in the context of the rules of fiqh. Initially this activity has been started individually and then gained institutional characteristic and caused to formation of fetwa institution. Fetwa institution have been fulfilled the duty for protecting the line of logic of Islam and for controlling the problem solving adequacy of rules of fiqh. Individuals ask some questions to muftis for organizing their lives with respect to religious rules as well. This study have been prepared for determining the similarity and difference of past and present role of the fetwa institution and the issues that indivuals needs more and the problems that existing. In the first section of the study, it has been included the conceptual framework and the historical development of fetwa. In the second section, it has been tried to analyze the questions which being a matter of fetwa. The questions have been analyzed in eight sections: religion, creed, principles of jurisprudence, worships, lawful and unlawful, criminal law, civil law, legal and commercial life, social life and current life. In the third section, it has been included the evaluation of the findings of the second section. In this section, firstly it has been tried to determine the factors causing the questions asked by individuals. Then, the factors that cause to change in the issues of fetwa have been analyzed. At the end, audience profile, quick religious problems of people and current problems of fetwa institution has been debated and necessary works has been mentioned. IV

ÖZET İslam tarihinin ilk dönemlerinden günümüze bireyler dini konulardaki problemlerini, fıkhi kaideler içinde çözmek için fakihlere müracaat etmişlerdir. İlk etapta bireysel olarak başlayan bu faaliyet daha sonra kurumsal bir nitelik kazanarak fetva müessessinin oluşmasına sebep olmuştur. İslam dininin mantık çizgisini koruma ve fıkıh kaidelerinin problemleri çözmede yeterli olup olmadığım kontrol vazifesini fetva kurumu yerine getirmiştir. Günümüzde de bireyler hayatlarım dini kurallara göre düzenlemek için fakihlere bir takım sorular yöneltmektedirler. Bu çalışma fetva kurumunun geçmişteki rolü ile günümüzdeki rolü arasındaki benzer ve farklı noktalan tespit etmek, bireylerin hangi alanlarda fetvaya daha çok ihtiyaç duyduklarım saptamak, ve ortaya çıkan problemleri tespit etmek için hazırlanmıştır. Çalışmanın ilk bölümünde fetvanın kavramsal çerçevesi ve tarihsel gelişimine yer verilmektedir, ikinci bölümde ise, fetvaya konu olan soruların analizi yapılmaya çalışılmaktadır. Sorular din, akaid, fıkıh usulü, ibadetler, haram ve helaller, ukubat, muamelat, hukuki ve ticari hayat, sosyal hayat ve güncel olmak üzere sekiz bölümde incelenmektedir. Üçüncü bölümde ise ikinci bölümde elde edilen bulguların değerlendirilmesine yer verilmektedir. Bu bölümde ilk olarak, bireylerin sordukları sorulara yol açan faktörler tespit edilmeye çalışılmaktadır. Daha sonra fetva konularının değişmesine sebep olan etkenler incelenmektedir. Sonda da bulgulardan hareketle dinleyici profili, halkın din konusundaki öncelikli sorunları ve fetva kurumunun güncel problemleri tartışılmış ve gerekli çalışmalara değinilmiştir. iii
