Abstract

Em 1999, durante a 87ª Conferência Internacional do Trabalho, foi formalizado pela Organização Internacional do Trabalho o termo trabalho decente, o qual sintetiza a missão histórica da OIT em promover oportunidades para que homens e mulheres tenham um trabalho produtivo e de qualidade, em condições de liberdade, equidade, segurança e dignidade. O Governo brasileiro, por meio do então Presidente da República Luiz Inácio Lula da Silva, junto ao ex Diretor Geral da OIT, Juan Somavia, assinaram, em 2003, um Memorando de Entendimento que previa o estabelecimento de um programa de cooperação técnica para a promoção de uma Agenda Nacional de Trabalho Decente no País. A partir de então, a promoção do trabalho decente passou a ser uma prioridade política no Brasil. Posto isto, ante a convicção de que o direito fundamental ao trabalho é um direito universal de todos os homens e que o trabalho deve ser fator de dignidade, a presente dissertação analisará o conceito do trabalho decente, sua promoção no Brasil, a atuação das políticas públicas para o enfretamento às piores formas de exploração de trabalho, bem como o modo pelo qual o trabalho decente tem sido abordado pelo Tribunal Superior do Trabalho. Quanto ao método científico, trata-se de uma abordagem multimetodológica dedutivo e indutivo, qualitativa e quantitativa, pautada no levantamento de dados por meio de pesquisa bibliográfica, documental e jurisprudencial, visando o aprofundamento do conceito, dos elementos caracterizadores do instituto em investigação e a observação dos impactos sociais e jurídicos no contexto do trabalho decente.

In 1999, during the 87th Internacional Labour Conference, the term decent work was formalized by the Internacional Labour Organization which summarises the ILO´s historic mission to promote opportunities for men and women to have a productive and quality work environment, in terms of freedom, equity, safety and dignity. The Brazilian Government, through the then President of the Republic Luiz Inácio Lula da Silva, alongside with the former General Director of the ILO, signed in 2003 a Memorandum of Understanding which forsaw the establishment of a technical cooperation programme for the promotion of a National Agenda for Decent Work in the Country. Since then, promoting the so called decent work has become a political priority in Brazil. Having said that, the belief that the fundamental right to work is a universal right of all of mankind and that it should be a factor of dignity, this dissertation will analyze the concept of decent work, its advocacy in Brazil, the performance of public policies to fight the worst forms of work exploitation as well as the way in which decent work has been addressed by the Superior Labour Court. As for the scientific method, it is a qualitative and quantitative multimethodological approach, based on data collection from documents as well as through bibliographic and jurisprudential research. All of that aiming to deepen the concept, the characterizing elements of the institute under investigation and the observation of social and legal impacts within the context of decent work
