Abstract

À partir d'une maxime stigmatisant la nécessaire différence d'âge entre l'adoptant et l'adopté posée par le droit de Justinien, les juristes médiévaux sont parvenus, en quelques siècles, à reconstruire entièrement les règles juridiques relatives à la filiation adoptive. Si celle-ci, à leurs yeux, doit en tout point « imiter la nature », c'est pour mieux se conformer à un ordre divin de l'univers se matérialisant par une procréation légitime dans le mariage. Indirectement, il en résulte donc une exaltation des liens du sang qui conduit à reléguer au second plan la filiation adoptive, désormais jugée inférieure à la filiation naturelle.
