Эффективность законодательного управления правовой судьбой невостребованных земельных долей

Abstract

Раскрывается правовая сущность законодательных изменений, внесенных в Закон «Об обороте земель сельскохозяйственного назначения» Федеральным законом от 29 декабря 2010 г. № 435-ФЗ. Анализируются существенные изменения по определению понятия невостребованной земельной доли, новому порядку их выделения в земельные участки. Дается положительная оценка нововведений, закрепляющих предоставление сельскохозяйственным организациям и фермерским хозяйствам преимущественного права выкупа невостребованных земельных долей после их перехода в муниципальную собственность по приемлемой фиксированной цене.

The article examines the legal principles underlying legislative changes to the Law "On Agricultural Land Transactions" made by the Federal Law of December 29, 2010 № 435-FZ. Consideration is given to significant changes in the definition of unclaimed land shares and the new order of their allotment. The author assesses positively the innovations regarding pre-emptive rights given to agricultural organizations and farmers to buy unclaimed land shares for an affordable fixed price after their transfer to municipal property.
