Abstract

El ordenamiento jurídico, específicamente el contenido en el Código de la Niñez y Adolescencia, refería en su artículo 106, números 2 y 4, la preferencia de la madre frente a los procedimientos judiciales la tenencia y patria potestad de los niños, niñas y adolescentes. El propósito de esta investigación fue realizar un análisis a la Sentencia No. 28-15-IN/21, de la Corte Constitucional que declara la inconstitucionalidad por el fondo de las frases la patria potestad de los que no han cumplido doce años se confiará a la madre y se preferirá a la madre, siempre que no afecte el interés superior del hijo o la hija, por ser estas contrarias al principio de interés superior de niños, niñas y adolescentes, y porque las mismas vulneran el derecho a la igualdad, y a la corresponsabilidad parental. Es por ello que la investigación presenta como objetivo: realizar un estudio neutrosófico sobre el conocimiento de estudiantes universitarios del derecho a la igualdad, y a la corresponsabilidad parental, en los procesos judiciales de patria potestad y tenencia de niñas, niños y adolescentes. La metodología utilizada fue mixta cuali-cuantitativa, afirmada bajo los tipos de investigación descriptiva, y transversal. Una vez aplicados los métodos se obtuvieron resultados que denotan la necesidad de proseguir investigando esta temática.
