Podmiotowość adresata prawa w koncepcji Lona L. Fullera

Abstract

The article's goal is to show the personhood of the addressee of the law in L.L. Fuller's doctrine. It brings requirements and limitations against the legislator and is fundamental to other Fuller's postulates. On the example of the current Polish legal order, it is shown as a crucial element of his doctrine. Without appreciation of the personhood of the addressee of the law as the foundation of the legal order, other postulates are ineffective, despite they may be present in the legal system.

Artykuł ma na celu ukazanie podmiotowości adresata prawa na poziomie fundamentalnym w doktrynie L.L. Fullera. Wnosi ona wymagania i ograniczenia względem prawodawcy i stanowi fundament dla innych postulatów Fullera. Na przykładzie obecnego porządku prawnego w Polsce zostaje wskazane, że jest to kluczowy element jego doktryny. Bez uznania podmiotowości adresata prawa za fundament porządku prawnego inne postulaty okazują się nieskuteczne, mimo ich zawarcia w systemie prawa.
