PROTEÇÃO JURÍDICA E A JUDICALIZAÇÃO DO DIREITO À EDUCAÇÃO DA PESSOA COM TRANSTORNO DO ESPECTRO AUTISTA (TEA)

Abstract

O presente trabalho aborda a relação entre os fundamentos legais de proteção aos indivíduos com Transtorno do Espectro Autista (TEA) e o direito à educação. O TEA é um transtorno de neurodesenvolvimento que afeta o desenvolvimento intelectual e a cognição, tornando necessário o amparo legal e uma educação inclusiva para promover a socialização dessas pessoas. A proteção legal do direito à educação para portadores de TEA é garantida por diversas normas e leis que visam assegurar o acesso à educação de qualidade e inclusiva. A metodologia utilizada para a pesquisa foi o método descritivo, com base em pesquisa bibliográfica e análise qualitativa, utilizando leis, doutrinas, sites, revistas online, livros, artigos jurídicos e científicos, e teses. O objetivo era compreender a proteção legal dos direitos das pessoas com TEA, considerando o princípio de igualdade perante a lei, conforme estabelecido no artigo 5º da Constituição Federal. Conclui-se que os indivíduos autistas possuem diversos direitos que contribuem para sua inclusão social, em especial o direito à educação inclusiva. No entanto, ainda existem situações que impedem o pleno exercício desses direitos.
