La necesidad de identificar la violencia sexual etiquetante en las redes sociales dentro del SIJ y Ecuador: Los ataques hater como tipo penal.

Abstract

Este artículo busca aportar a la construcción e interpretación jurídica de la noción de ataque hater como tipo penal dentro el marco jurídico interamericano, en el derecho comparado y a la luz del enfoque de género. Se describen los antecedentes conceptuales en el derecho penal internacional, en la criminología sobre etiquetamiento/reacción social, y el derecho comparado, tanto para su tipificación como para sus consecuencias en la libertad de expresión. Se concluye a) acerca de la antijuridicidad del ataque hater cuando éste busca dañar la integridad sexual, psicológica, física, así como la relativa a la honra y la dignidad de la persona, b) La precariedad instrumental de normas sobre virtualidad global en las convenciones y tratados internacionales. Se propone proyectar la interpretación del fenómeno a través de la legislación de este tipo penal preciso, con el fin de prevenir el delito dentro o fuera del ciberespacio, relacionado con las formas emergentes de discriminación en las redes sociales. - We are trying to contribute to the construction and legal interpretation of the notion of hater attack (ataque hater, in Spanish) as a criminal offense within the inter-American legal framework, in comparative law and in light of the gender approach. We start describing the conceptual antecedents in International Criminal law, in Criminology (on labeling/social reaction), and some compared law (about similar typifications and about its possible consequences on freedom of expression). It is concluded a) About the illegality of the hater attack when it seeks to damage the sexual, psychological, physical integrity, as well as the honor and dignity of the person, b) The instrumental precariousness of the conventions and international treaties laws according to the global virtual context. We propose to project the interpretation of the social phenomenon of haters through the legislation through this precise criminal type, in order to prevent crime inside and outside cyberspace.
