Abstract

Der Beitrag untersucht die Frage, ob die bei Gründung der Fachhochschulen vor gut 50 Jahren festgelegte Lehrverpflichtung für deren Professorinnen und Professoren vor dem Hintergrund der veränderten Aufgabestellungen der heutigen Hochschulen für angewandte Wissenschaften noch mit der Verfassung vereinbar ist. Überprüft werden Verstöße gegen den Gleichheitssatz in Art. 3 Abs. 1 GG durch eine ungerechtfertigte Ungleichbehandlung gegenüber Professorinnen und Professoren an Universitäten sowie durch eine ungerechtfertigte Gleichbehandlung gegenüber Lehrkräften für besondere Aufgaben an Universitäten und an Hochschulen für angewandte Wissenschaften, gegen die in Art. 5 Abs. 3 GG geschützte Freiheit der Forschung und gegen die von den allgemeinen Grundsätzen des Berufsbeamtentums in Art. 33 Abs. 5 GG umfasste Fürsorgepflicht des Dienstherrn. This paper expands on the question of whether teaching obligations for professors at “Fachhochschulen”, which were set over 50 years ago, are still compatible with German Basic Law against the background of the much broader tasks of today’s Universities of Applied Sciences, now comprising not only teaching but research, too. The review covers violations of the Principle of Equality in Article 3 (1) of the Basic Law through unjustified unequal treatment compared to professors at traditional Universities and through unjustified equal treatment compared to “Lehrkräfte für besondere Aufgaben” at, both, traditional Universities and Universities of Applied Sciences, of Freedom of Research protected in Article 5 (3) of the Basic Law and of the State’s general duty of care for it’s civil servants encompassed by Article 33 (5) of the Basic Law.
