This work presents the results of a brief census of documents relating to civil and criminal procedural practices written in Suevian age within the coastal dukedoms of Naples and Amalfi. The study aims at pointing out not only the characteristics of these documents that were produced in territories with strong identity roots influenced by the Byzantine ancestry, but also the emerging characters/figures placed/involved in such contexts. Most of the judicial documentation that has been examined comes from monastic and ecclesiastic archives. It is characterized by the persistence of archaic forms in documents as they were written by the “curiali” who were attached to documentary procedures of the ancient tradition and reluctant to innovation.

Si presentano i risultati di un primo sommario censimento della documentazione di età sveva prodotta nei ducati costieri di Napoli e Amalfi, territori fortemente identitari e notoriamente di ascendenza bizantina, relativa a pratiche processuali di ambito civile e penale con l’intento di dar conto delle specificità degli esiti documentari e delle figure emergenti in tali contesti. La documentazione giudiziaria considerata, proveniente perlopiù da fondi monastici e da archivi ecclesiastici, risulta caratterizzata dalla persistenza di strutture compositive arcaiche e dalla presenza pressoché costante dei curiali, figure ancora legate a forme e procedure documentarie di antica tradizione e poco aperte alle innovazioni.
