Abstract

[Português] O artigo objetiva elucidar a problemática recôndita por trás da restrição da doação sanguínea por homens homossexuais sob a égide da Constituição Cidadã/88 perscrutando destacar o teor discriminatório enraizado tanto na Resolução RDC nº 34/14, art. 25, XXX, quanto na Portaria nº 158/ 2016 em seu art. 64, IV. A abordagem versa sobre a conquista de revogação da restrição mencionada com fundamento na votação da Ação Direta de Inconstitucionalidade 5.543 pelo Supremo Tribunal Federal, destacando os impactos desse processo na sociedade para com o compromisso com o direito à vida e a solidariedade humana. Discorre, também, de forma empírica acerca da percepção dos desdobramentos do preconceito contra a homossexualidade e a forma que tais indivíduos são afetados pelos olhares tortos de uma sociedade doente que trata a orientação sexual alheia como uma patologia. Utilizou-se como a base de dados científica SciELO, CAPES, RT online, LILACS e portais virtuais jurídicos. [English] The article aims to elucidate the hidden problem behind the restriction of blood donation by homosexual men under the aegis of the Citizen Constitution / 88, seeking to highlight the discriminatory content rooted both in Resolution RDC nº 34/14, art. 25, XXX, and in Ordinance No. 158/2016 in its art. 64, IV. The approach deals with the achievement of the revocation of the mentioned restriction based on the vote of the Direct Action of Unconstitutionality 5,543 by the Supreme Federal Court, highlighting the impacts of this process on society towards the commitment to the right to life and human solidarity. It also discusses in an empirical way about the perception of the consequences of prejudice against homosexuality and the way that these individuals are affected by the crooked looks of a sick society that treats the sexual orientation of others as a pathology. It was used as the scientific database SciELO, CAPES, RT online, LILACS and legal virtual portals.
