Modelo de recomendación para el perfeccionamiento de los consentimientos del procedimiento arbitral CIADI en Bolivia, Ecuador y Venezuela mediante neutrosofía

Abstract

Dans le présent travail, les différents aspects relatifs à la dénonciation de la Convention de Washington ou Convention pour le règlement des différends relatifs aux investissements entre États et ressortissants d'autres États de 1965, du Centre international pour le règlement des différends relatifs aux investissements (CIRDI) par l'Équateur, la Bolivie et le Venezuela ont été analysés. Les faits survenus, les positions desdits États pour prendre en considération la dénonciation de la convention, les conséquences de la dénonciation et les départs possibles des acteurs impliqués sont analysés à travers un modèle de recommandation dans la solution pour l'amélioration des consentements de la procédure d'arbitrage du CIRDI en Bolivie, en Équateur et au Venezuela par le biais de la neutralité.

En el presente trabajo se analizaron los variosaspectos relativosa la denuncia del Convenio de Washington o Convenio sobre Arreglo de Diferencias de las Inversiones entre Estados y Nacionales de otros Estados de 1965, del Centro Internacional de Arreglo de Diferencias Relativas a Inversiones (CIADI) por parte de Ecuador, Bolivia y Venezuela. Los hechos acaecidos, las posiciones de dichos estados para tomar en consideracion la denuncia del convenio, las consecuencias de la denuncia y lasposibles salidas de los actores involucrados son analizados a traves de un modelo derecomendacion en la solucion para el perfeccionamiento de los consentimientos del procedimiento arbitral CIADI en Bolivia, Ecuador y Venezuelamediante neutrosofia.

In this work, the various aspects related to the denunciation of the Washington Convention or Convention on the Settlement of Investment Disputes between States and Nationals of other States of 1965, of the International Center for the Settlement of Investment Disputes (ICSID) by Ecuador, Bolivia and Venezuela were analyzed. The events that occurred, the positions of said states to take into consideration the denunciation of the agreement, the consequences of the denunciation and the possible departures of the actors involved are analyzed through a recommendation model in the solution for the improvement of the consents of the ICSID arbitration procedure in Bolivia, Ecuador and Venezuela through neutrosophy.

في هذا العمل، تم تحليل الجوانب المختلفة المتعلقة بانسحاب الإكوادور وبوليفيا وفنزويلا من اتفاقية واشنطن أو اتفاقية تسوية منازعات الاستثمار بين دول ورعايا الدول الأخرى لعام 1965، والمركز الدولي لتسوية منازعات الاستثمار. يتم تحليل الأحداث التي وقعت، ومواقف الدول المذكورة لمراعاة الانسحاب من الاتفاقية، وعواقب الانسحاب والخروج المحتمل للجهات الفاعلة المعنية من خلال نموذج توصية في الحل لتحسين موافقات إجراءات التحكيم الخاصة بالمركز الدولي لتسوية منازعات الاستثمار في بوليفيا والإكوادور وفنزويلا من خلال نظرية العدلات.
