Abstract

La posibilidad de renunciar al procedimiento penal cuando el sujeto que aparece investigado o imputado es un extranjero con orden administrativa de expulsión pendiente de ejecución está recogida en nuestro ordenamiento jurídico en el art. 57.7 de la Ley de Extranjería. Pese a la excepcionalidad que representa en nuestro sistema esta fusión entre política migratoria y política criminal, no existe ningún trabajo empírico que haya tratado de profundizar sobre cómo se está llevando a cabo su aplicación, ni tampoco sobre las características de los delitos o el perfil de las personas sobre las que recae. Con intención de llenar ese vacío de conocimiento, se ha procedido al estudio en profundidad de una muestra de expedientes judiciales procedentes de los juzgados de Málaga en los que se solicitó la renuncia penal en favor de la expulsión administrativa. Los resultados revelanun conjunto de disfunciones que hacen cuestionar tanto su eficacia como su legalidad. Se discuten las implicaciones legales y criminológicas
