Abstract

Tratado de Historia del Derecho - Libro I es una obra co-creada con asistencia de inteligencia artificial (Claude AI de Anthropic), bajo la dirección creativa, estructuración, edición y curaduría intelectual de Mauricio Ochoa Urioste. Este primer volumen constituye un estudio comprehensivo sobre el origen y desarrollo de los sistemas jurídicos en las civilizaciones antiguas, analizando la transición desde las formaciones normativas preliterarias hasta las primeras grandes codificaciones escritas de la humanidad. La obra examina cómo el derecho surge intrínsecamente vinculado a las estructuras sacro-políticas, explorando las cosmovisiones míticas que fundamentaron los primeros órdenes normativos. A través de un enfoque interdisciplinario que integra historia del derecho, antropología jurídica y estudios comparados, se analiza la evolución desde los sistemas de transmisión oral hasta la monumentalización escrita de las normas. El tratado abarca las principales tradiciones jurídicas de la antigüedad: desde los códigos mesopotámicos (con especial atención al Código de Hammurabi) hasta el concepto de Maat en el Egipto faraónico; desde los sistemas normativos del Valle del Indo y las dinastías chinas Shang y Zhou, hasta las sofisticadas instituciones jurídicas de las civilizaciones precolombinas (aztecas e incas). Particular atención se presta a conceptos fundamentales como el tabú, el totemismo y los sistemas vindicatorios primitivos, revelando cómo estas formas primordiales de normatividad configuraron las bases del pensamiento jurídico posterior. El análisis culmina con el estudio del tránsito crucial desde el ritual hacia la codificación escrita, momento fundacional en la historia del derecho. Esta obra está dirigida a estudiantes y académicos de Historia del Derecho, Derecho Comparado, Antropología Jurídica e Historia Antigua, ofreciendo una visión integral de cómo las primeras civilizaciones humanas conceptualizaron y articularon el orden jurídico, sentando las bases para el desarrollo posterior del derecho occidental y oriental.
