Descentralización laboral en el mercado interior y empresas buzón: mitos y realidades

Abstract

En este capítulo, se aborda el fenómeno de la descentralización productiva y laboral en el marco europeo, centrándose especialmente en las conocidas como “empresas buzón”. Estas entidades tienen su sede en un Estado miembro, sin embargo, desarrollan la mayor parte de sus actividades en otros países donde no resultan aplicables todas o parte de las obligaciones impuestas. Esta estrategia de localización de conveniencia provoca la elusión de normas (fiscales, laborales y de seguridad social, principalmente) que serían aplicables en el desarrollo de actividades productivas, generando evasión fiscal y otros problemas relacionados con la movilidad transfronteriza, como son la competencia desleal y el dumping social. Estas empresas tienen efectos perniciosos en el mercado interior, lo que ha llevado a las instituciones europeas y al Tribunal de Justicia de la Unión Europea (TJUE) a buscar soluciones para combatir sus prácticas fraudulentas. Este fenómeno es amplio y complejo como así reconoce la doctrina iuslaboralista. Por ello, este trabajo se enfoca en la delimitación conceptual y jurisprudencial de estas entidades dentro del marco de la descentralización productiva y laboral, especialmente en relación con la subcontratación internacional de servicios y el desplazamiento de trabajadores. También examina las implicaciones legales que plantean estas empresas con el objetivo de comprender mejor su funcionamiento y los desafíos que representan para la protección de los derechos laborales y la integridad del mercado interior en la UE.
