A NECESSIDADE DO CONTROLE DE CONVENCIONALIDADE EVIDENCIADA PELO CASO GOMES LUND

Abstract

Esta pesquisa estuda a teoria do controle de convencionalidade, que visa assegurar que a legislação interna do Brasil esteja em conformidade com os tratados internacionais de direitos humanos, como a Convenção Interamericana de Direitos Humanos. É contextualizada a discussão no histórico de violações de direitos humanos no Brasil, destacando o caso Gomes Lund, uma vítima do extermínio durante a Guerrilha do Araguaia. O processo judicial relacionado a esse caso enfrentou obstáculos significativos devido à Lei da Anistia, o que evidencia a necessidade de um controle de convencionalidade mais eficaz para a proteção dos direitos humanos. A metodologia empregada inclui uma análise qualitativa e dedutiva, com revisão de literatura sobre controle de convencionalidade e constitucionalidade, além de uma investigação dos desdobramentos do caso mencionado.

This research studies the theory of conventionality control, which aims to ensure that Brazil's domestic legislation is in compliance with international human rights treaties, such as the Inter-American Convention on Human Rights. The discussion is contextualized within the historical background of human rights violations in Brazil, highlighting the Gomes Lund case, a victim of extermination during the Araguaia Guerrilla. The judicial process related to this case faced significant obstacles due to the Amnesty Law, which underscores the need for a more effective conventionality control for the protection of human rights. The methodology employed includes a qualitative and deductive analysis, with a literature review on conventionality and constitutionality control, as well as an investigation into the developments of the mentioned case.
