Abstract

La figura jurídica de “la adopción” configura una relación paterno-filial plena respecto a los adoptantes y el adoptado. Contrariamente a lo que dictaminan los ordenamientos jurídicos civiles de otros países, nuestro código del 84 no regula, protege ni conserva la información del adoptado en lo que se refiere a la identidad de sus progenitores o su historial médico, mucho menos el de su familia de origen. El siguiente artículo se enfoca en las relaciones de adopción, el derecho a la identidad y el rol del Estado en el resguardo de la información biológica del adoptado. Asimismo, tiene como objetivo analizar y verificar si el marco normativo de la adopción limita el derecho del adoptado a conocer su identidad biológica e impide su pleno desarrollo en sociedad. Para ello, se desarrollarán conceptos básicos un análisis sistemático de los códigos civiles del Perú, Argentina y España, a fin de garantizar un ejercicio comparativo sobre el resguardo de la información del adoptado y velar por la protección de sus derechos de manera más integral.

The legal figure of "adoption" configures a full parent-child relationship with respect to the adopters and the adoptee. Contrary to what is dictated by the civil legal systems of other countries, our code of 84 does not regulate, protect or preserve the information of the adoptee regarding the identity of their parents or their medical history, much less that of their family of origin. The following article focuses on adoption relationships, the right to identity and the role of the State in safeguarding the adoptee's biological information. Likewise, its objective is to analyze and verify if the regulatory framework of adoption limits the right of the adoptee to know his biological identity and prevents his full development in society. For this, basic concepts will be developed, a systematic analysis of the civil codes of Peru, Argentina and Spain, in order to guarantee a comparative exercise on the protection of the information of the adoptee and ensure the protection of their rights in a more comprehensive way.
