Fundamental Rights of Children and Adolescents Violated by the Practice of Sharenting in Brazil.

Abstract

The present work addresses sharenting: exposure of information of children and adolescents in the virtual environment by their country or guardians, a relevant topic in the legal field, as it violates the fundamental rights of people under eighteen years of age. Therefore, the main scope of this work is to study the fundamental rights of children and adolescents who are disrespected when their parents or guardians disclose their data on the world wide web. Furthermore, its specific objectives are: research into the parental role; analyze sharenting; investigate fundamental rights. The research using bibliographic, documentary, descriptive and qualitative methodology was carried out using the hypothetical-deductive method. When investigating the subject, the results revealed that the practice of sharenting violates the following fundamental rights: security, provided for in article 5, caput of the Magna Carta; the privacy of article 5, section X of the Constitution, which includes intimacy, private life, honor and image; the protection of your personal data, as set out in article 5, item LXXIX of the aforementioned Political Charter; the freedom to give an opinion regarding their information that will be displayed on the internet, in accordance with article 16, item II of the Child and Adolescent Statute; respecting article 17 of Law No. 8,069 of 1990; and the dignity of children and adolescents of the aforementioned law.

O presente trabalho aborda o sharenting: exposição de informações de crianças e adolescentes no âmbito virtual por seus país ou responsáveis, temática relevante no âmbito jurídico, dado que viola direitos fundamentais das pessoas com menos de dezoito anos. Logo, o escopo principal desse trabalho é estudar os direitos fundamentais de crianças e adolescentes desrespeitados quando seus pais ou responsáveis divulgam seus dados na rede mundial de computadores. Ademais, possui como objetivos específicos: pesquisar sobre a função parental; analisar o sharenting; investigar os direitos fundamentais. A pesquisa de metodologia bibliográfica, documental, descritiva e qualitativa foi realizada por meio do método hipotético-dedutivo. Ao perquirir sobre o assunto, identificou-se identificaram-se, como resultados, que a prática do sharenting desobedece aos seguintes direitos fundamentais: à segurança, previsto no artigo 5º, caput da Carta Magna; à privacidade do artigo 5º, inciso X da Constituição, que inclui intimidade, vida privada, honra e imagem; à proteção de seus dados pessoais, disposto no artigo 5º, inciso LXXIX da referida Carta Política; à liberdade de opinar a respeito de suas informações que serão expostas na internet, conforme artigo 16, inciso II do Estatuto da Criança e do Adolescente; ao respeito do artigo 17 da Lei nº 8.069 de 1990; e à dignidade da criança e do adolescente da mencionada lei.
