Abstract

Durante los últimos años, el fortalecimiento de las demandas formuladas desde el movimiento feminista frente a las desigualdades de género permitieron instalar distintos debates en las agendas pública, política y mediática así como la sanción de nuevas leyes en Argentina. Desde la perspectiva de Nancy Fraser, esos nuevos marcos legales deben constituirse a partir de reivindicaciones de redistribución y reconocimiento para alcanzar la justicia. El presente trabajo tiene como objetivo indagar a qué concepción de justicia responden esas leyes. A nivel metodológico, se realizó una selección y clasificación de leyes con alcance en la provincia de Buenos Aires que tienen como objetivo reducir las desigualdades de género. Entre las reflexiones finales se destacan los avances en relación a las leyes que se vinculan a la dimensión del reconocimiento y la escasez de medidas en el plano de la redistribución económica, lo que provoca el riesgo de truncar el alcance de la justicia.

In recent years, the strengthening of the demands formulated by the feminist movement against gender inequalities have allowed the installation of different debates in the public, political and media agendas, as well as the sanction of new laws in Argentina. From Nancy Fraser's perspective, these new legal frameworks must be constituted from redistribution and recognition claims to achieve justice. The objective of this paper is to investigate what conception of justice these laws respond to. At the methodological level, a selection and classification of laws with scope in the province of Buenos Aires that aim to reduce gender inequalities was carried out. Among the final reflections, the advances in relation to the laws that are linked to the dimension of recognition and the scarcity of measures in the area of economic redistribution stand out, which causes the risk of truncating the scope of justice.

Nos últimos anos, o fortalecimento das reivindicações formuladas pelo movimento feminista contra as desigualdades de género permitiu a instalação de diferentes debates nas agendas públicas, políticas e mediáticas, bem como a sanção de novas leis na Argentina. Na perspectiva de Nancy Fraser, estes novos quadros jurídicos devem ser constituídos a partir de reivindicações de redistribuição e reconhecimento para alcançar a justiça. O objetivo deste artigo é investigar a que concepção de justiça respondem essas leis. A nível metodológico foi realizada uma seleção e classificação de leis com alcance na província de Buenos Aires que visam reduzir as desigualdades de género. Entre as reflexões finais destacam-se os avanços em relação às leis que estão ligadas à dimensão do reconhecimento e a escassez de medidas na área da redistribuição económica, o que provoca o risco de truncar o âmbito da justiça.
