Abstract

Modern Russia needs the balanced development of the legislation. Any examination of the legislation an ultimate goal has increase in its efficiency that can be reached by reduction of excessive plurality of regulations, completion of their whitespaces, elimination of discrepancy between laws and by that consolidation of system of the legislation. According to the role which examination should play in preparation and adoption of laws it can fairly be the most important technological stage of legislative activity. Examination is of particular importance today when adoption of the effective, legally competent, working laws, timeliness and accuracy of legislative decisions become in many respects the defining factor of economic, political, social development. In this article the author investigated the concept and classification of examinations by various bases. In the Russian legal practice there is no fixed uniform interpretation of examination of the legislation, in scientific literature there were also various approaches to understanding of this legal institute, and also to the formulation of types of examinations. The author allocated the new type of pedagogical examination. The institute of pedagogical examination wasn't in the previous Education law and is the legal innovation brought by the Federal law of the Russian Federation «About education in the Russian Federation» № 273-FL from 29.12.2012. Pedagogical examination represents the analysis of the developed or operating standard and legal base in the field of education. A main objective of pedagogical examination is the identification and prevention of establishment by the legislator of the provisions promoting negative impact on quality of training in educational programs of a certain level and (or) an orientation and condition of their development by students. In article the author noted that the conclusion made by results of conducting pedagogical examination is subject to obligatory consideration of the executive authority by federal organ which developed the draft of the regulatory legal act or adopted the regulatory legal act which was object of pedagogical examination.

Современной России необходимо сбалансированное развитие законодательства. Любая экспертиза законодательства конечной целью имеет повышение его эффективности, что может быть достигнуто путем сокращения излишней множественности нормативных актов, восполнения их пробельности, устранения противоречивости между законами и тем самым упрочения системности законодательства. По той роли, которую экспертиза призвана играть в подготовке и принятии законов, ее справедливо можно отнести к важнейшему технологическому этапу законотворческой деятельности. Особое значение экспертиза приобретает сегодня, когда принятие эффективных, юридически грамотных, работающих законов, своевременность и точность законодательных решений становятся во многом определяющим фактором экономического, политического, социального развития. В данной статье исследуются понятие и классификация экспертиз по различным основаниям. В российской правовой практике не закреплено единообразной трактовки экспертизы законодательства, в научной литературе также сложились различные подходы к пониманию этого правового института, а также к формулировке видов экспертиз. Особо выделяется новый вид педагогической экспертизы. Институт педагогической экспертизы не был закреплен в предыдущем Законе об образовании и является правовым новшеством, внесенным Федеральным законом РФ «Об образовании в Российской Федерации» № 273-ФЗ от 29.12.2012 г. Педагогическая экспертиза представляет собой анализ разрабатываемой или действующей нормативно-правовой базы в области образования. Основная цель педагогической экспертизы выявление и предотвращение установления законодателем положений, способствующих негативному воздействию на качество обучения по образовательным программам определенного уровня и (или) направленности и условия их освоения обучающимися. В статье отмечается, что заключение, составленное по результатам проведения педагогической экспертизы, подлежит обязательному рассмотрению федеральным органом исполнительной власти, разработавшим проект нормативного правового акта или принявшим нормативный правовой акт, являвшийся объектом педагогической экспертизы.
