Abstract

Il saggio, prendendo le mosse da una concezione ampia del fenomeno successorio, si propone di analizzare il rapporto tra le disposizioni di carattere non patrimoniale e l’atto di ultima volontà, con particolare attenzione sia al testamento che ad atti da esso diversi. Si propone una lettura che tenga conto della natura esistenziale degli interessi rilevanti nel caso concreto al fine di individuare la disciplina applicabile, sia essa formale che sostanziale. L’analisi si concentra, poi, sulle recenti novità introdotte in tema di destinazione del corpo e dei tessuti post mortem ai fini di studio, formazione e ricerca scientifica (l. 10/2020), con particolare attenzione alla qualificazione dell’atto di manifestazione del consenso e alla capacità di disporre. Infine, lo sguardo è rivolto alla criopreservazione del cadavere, valutandone l’ammissibilità in relazione ai principi di solidarietà e dignità della persona. Taking a broad conception of the inheritance phenomenon as a starting point, the essay aims to analyze the relationship between dispositions of a non-patrimonial nature and the act of last will, with particular attention to both the will and acts other than it. It is proposed an interpretation that considers the existential nature of the relevant interests in the concrete case in order to identify the applicable discipline, whether formal or substantive. Then, the analysis focuses on the recent introduction of the destination of the body and tissues post-mortem for purposes of study, training and scientific research (l. 10/2020), with particular attention to the qualification of the act of manifestation of consent and the ability to dispose. Eventually, the focus is on the cryopreservation of the corpse, evaluating the admissibility of it in relation to the principles of solidarity and dignity of the person.
