Abstract

Overeenkomstig het beginsel “in foro interno et in foro externo” neergelegd in artikel 167 van de Grondwet is elke overheid (federale overheid, gemeenschap of gewest) nadrukkelijk bevoegd voor de buitenlandse betrekkingen met inbegrip van het sluiten van verdragen, in aanlegenheden waarvoor deze internrechtelijk bevoegd is. In deze bijdrage worden de contouren en de uitgangspunten van het bevoegdheidsrechtelijke beginsel “in foro interno et in fore externo” geanalyseerd, en wordt ingegaan op de concrete toepassing ervan. Er wordt aandacht besteed aan de grijze zones en aan de gevallen waar het in conflict treedt met andere bevoegdheidsrechtelijke beginselen. L’article 167 de la Constitution consacre le principe du parallélisme des compétences, habituellement retraduit par l’adage in foro interno et in foro externo : il appartient à chacune des collectivités politiques (fédérale, communautaire ou régionale), et à elle seule, de conduire les relations internationales dans les matières pour lesquelles elle est compétente « à l’interne ». La présente contribution analyse les contours et ressorts de ce principe, pour ensuite en examiner l’application concrète dans la problématique de l’assentiment aux traités. Une attention est portée aux « zones grises » de la problématique et des frictions susceptibles de survenir entre le principe concerné et d’autres principes de répartition des compétences.
