Abstract

The aim of public administration, which is an important part of the executive power in modern states, is to perform public services through public officials and public goods, thus providing the public interest. The concept of "public interest", which came to the fore in the development process of modern public administration understanding, contributed to the development of the idea of "public administration ethics". In this process, some international organizations have developed ethical principles and standards that must be followed in public administration. However, the development of ethical principles and standards was not enough to prevent unethical attitudes and behaviors.There are various studies that show that unethical attitudes and behaviors are common in Turkish public administration. The most important reason for this is that the problem of unethical attitudes and behavior in Turkey has been ignored for many years. The most important step in the field of ethics in Turkey was taken with Law No. 5176 on “Establishment of an Ethics Committee for Public Officials and Amendments to Some Laws” enacted in 2004. With the said law, the ethical principles and standards that were previously scattered in the Turkish legislation were gathered together in a systematic way and the “Public Servants Ethics Board” was established.In the study, the obligation of public officials, one of the most important elements of public administration, to comply with ethical values is discussed. In the study, in which the citation and indirect expression method are applied, the literature and legal regulations related to the subject are discussed, firstly, ethics, morality, the relationship between ethics and public administration are discussed, and then what has been done about ethics in public administration and the results obtained are mentioned in Turkey and in the world. In addition, suggestions are made on what needs to be done in order to develop and establish an understanding of ethics in public officials.

Modern devletlerdeki yürütme erkinin önemli bir parçası olan kamu yönetiminin amacı, kamu görevlileri ve kamu malları aracılığıyla kamu hizmetlerini gerçekleştirmek, böylece kamu yararını sağlamaktır. Modern kamu yönetimi anlayışının gelişim sürecinde ön plan çıkan “kamu yararı” kavramı, “kamu yönetimi etiği” düşüncesinin gelişimine katkı sunmuştur. Bu süreçte bazı uluslararası kuruluşlar kamu yönetiminde uyulması gereken etik ilke ve standartlar geliştirmişlerdir. Ancak etik ilke ve standartların geliştirilmesi etik-dışı tutum ve davranışları önlemeye yetmemiştir. Türk kamu yönetiminde de etik-dışı tutum ve davranışların yaygın olduğu yönünde çeşitli araştırmalar bulunmaktadır. Bunun en önemli sebebi, Türkiye’de etik-dışı tutum ve davranış sorununun uzun yıllar boyunca göz ardı edilmesidir. Türkiye’de etik konusundaki en önemli adım 2004 yılında çıkarılan 5176 sayılı “Kamu Görevlileri Etik Kurulu Kurulması ve Bazı Kanunlarda Değişiklik Yapılması Hakkında Kanun” ile atılmıştır. Söz konusu kanunla daha önce Türk mevzuatında dağınık halde bulunan etik ilke ve standartlar, sistemli bir şekilde bir araya toplanmış ve “Kamu Görevlileri Etik Kurulu” kurulmuştur. Çalışmada, kamu yönetiminin en önemli unsurlarından biri olan kamu görevlilerinin etik değerlere uyma yükümlülüğü ele alınmaktadır. Alıntısal ve dolaylı anlatım yönteminin uygulandığı, konuyla ilgili literatürler ve yasal düzenlemeler ele alındığı çalışmada, öncelikle etik, ahlak, kamu yönetimi ile etik ilişkisine değinilmiş ardından Türkiye ve dünyadaki kamu yönetiminde etik konusunda yapılanlara ve elde edilen sonuçlar üzerinde durulmuştur. Ayrıca, kamu görevlilerinde etik anlayışının geliştirilmesi ve yerleştirilmesi için yapılması gerekenler konusunda önerilerde bulunulmaktadır.
