Este artículo contiene reflexiones y sugerencias elaboradas por un lingüista y un juez para redactar mejor las resoluciones judiciales que deben escribirse con corrección, claridad y precisión como una exigencia de la justicia de la decisión. Se exponen pautas que pretenden mejorar la redacción de estos textos jurídicos: pensar antes de escribir, redactar párrafos breves y de una idea, construir oraciones de 30 palabras, uso de la voz activa, el orden de la oración, uso correcto del gerundio, empleo del adjetivo «mismo», uso de «lo cual» para enlazar y recapitular, elegir las palabras adecuadas, algunos usos de la coma y la revisión de las resoluciones judiciales. El protagonismo de las resoluciones judiciales en el buen uso del lenguaje jurídico corresponde principalmente al Tribunal Supremo, al generar jurisprudencia. Por último, las habilidades de comunicación de la profesión del juez, como el de otros oficios, se deben enseñar en el inicio del ejercicio y recordar a lo largo del ejercicio profesional.
This article contains reflections and suggestions prepared by a linguist and a judge to better draft court decisions that it must be written with correctness, clarity and precision as a requirement of the justice of the decision. Guidelines are presented that aim to improve the writing of these legal texts: think before writing, write short paragraphs and an idea, construct sentences of 30 words, use of the active voice, the order of the sentence, correct use of the gerund, employment of the adjective «same», use of «which» to link and recapitulate, choose the right words, some uses of the comma and the review of court decisions. The prominence of judicial decisions in the proper use of legal language corresponds mainly to the Supreme Court, by generating jurisprudence. Finally, the communication skills of the judge’s profession, like that of other trades, should be taught at the beginning of the exercise and remembered throughout the professional practice.
