Admisibilidad del título valor electrónico en la legislación colombiana

Abstract

Mediante este estudio se pretende determinar la admisibilidad del título valor electrónico en la legislación colombiana, para lo cual se desarrolla un marco teórico compuesto de tres partes. Una primera parte donde se analiza la regulación de estos bienes mercantiles en el ordenamiento jurídico de nuestro país, determinando su origen histórico, el concepto de título valor, su naturaleza jurídica, función económica, los principios rectores de la institución, diversas formas de clasificación, algunas de las especies más importantes, la obligación cambiaria, ciertos procedimientos cambiarios y extracambiarios y finalmente, se establece la función e importancia que posee el documento dentro de esta figura. En la segunda parte, se estudia el concepto y función del documento electrónico, así como, su diferenciación frente a aquellos con soporte en papel. Luego se lleva a cabo una revisión de la regulación existente por parte de la Organización de las Naciones Unidas, Estados Unidos de Norte América, la Unión Europea, España, Italia, Francia, Argentina, Chile y finalmente, en Colombia.
