A prova do crime subjacente ao branqueamento de capitais

Abstract

A presente dissertação procura investigar os limites de valoração da prova indiciária no contexto do crime de branqueamento, mais concretamente, focando-se na questão de em que medida poderá ser o crime subjacente provado, num julgamento por branqueamento, mediante prova indiciária. Neste estudo analisou-se a problemática probatória que envolve todo o delito, os conceitos de indícios e como a doutrina e a jurisprudência os tem entendido, em certos momentos, entendidos como oportunos, foi ainda analisado um caso específico, mais concretamente, a operação marquês para comparar os fundamentos desta com as demais posições doutrinárias. Para chegarmos à nossa conclusão, coube-nos ainda demonstrar certos indícios que poderão ser entendidos como suficientes para provar a existência do crime subjacente ou que os bens provêm de um facto ilícito. Da análise crítica de todos os elementos da presente tese concluímos que a prova indiciária não pode ser entendida como inferior à prova direta e, como tal, desde que cumpridos certos requisitos, pode ser entendida como uma prova segura e forte para justificar uma condenação.
