O presente artigo tem por escopo realizar uma observação das teorias sistêmicas contemporâneas propostas por Niklas Luhmann e Gunther Teubner. À luz de tais perspectivas, o Direito pode ser observado como um subsistema social autopoiético, que se reproduz a partir de si mesmo, estabelecendo seus próprios limites de sentido. Enquanto Luhmann forja as bases epistemológicas de uma teoria jurídico-social autopoiética, Teubner vai além, afirmando que a autopoiese jurídica somente é possível no momento em que as relações autorreferenciais circulares dos componentes do sistema jurídico forem constituídas de modo a permitirem sua própria articulação e interligação num hiperciclo auto-reprodutivo. Entende-se que ambas as perspectivas sistêmicas podem ser vistas como complementares. A metodologia utilizada na presente pesquisa foi a perspectiva construtivista-sistêmica elaborada pela Teoria dos Sistemas Sociais (Luhmann). A técnica/método de pesquisa utilizado para a presente abordagem foi a bibliográfica. Com efeito, estas observações sistêmicas propõe uma alternativa viável à problemática do fechamento/abertura do sistema jurídico a partir da concepção de autopoiese.

This article’s scope is to perform an observation of the contemporary systemic theories proposed by Niklas Luhmann and Gunther Teubner. In the light of such perspectives, the Law can be seen as an autopoietic social subsystem, which is reproduced from itself, setting your own limits of meaning. While Luhmann forges the epistemological foundations of a legal and social autopoietic theory, Teubner goes further, stating that legal autopoiesis is possible only when the circular author-referential relationships of the legal system components are made in a way that allows their own articulation and interconnection in a self-reproductive hypercycle. It is understood that both systemic perspectives can be viewed as complementary. The methodology used in this research was the constructivist-systemic approach developed by the Theory of Social Systems (Luhmann). The technical/research method used for this approach was the bibliographic. Indeed, such systemic observations offer a viable alternative to the problem of the closing/opening of the legal system starting from the concept of autopoiesis.
