Abstract

No presente trabalho, discorremos a respeito de nova modalidade de celebração de contratos, denominado Smart Contracts, no qual com a vinda de novas tecnologias, a título de exemplo, Blockchain, nos possibilitou o vislumbre da nova tendência mundial. Portanto trata-se de um tema que tem sido instrumento de estudo nos últimos 10 anos, contudo, por ser uma tecnologia recente, muitos investidores demonstram incerteza e receio em sua utilização, haja vista possuir diversos questionamentos legais em relação a esta tecnologia. Para tanto, o presente trabalho vem apresentar a perspectiva legal quanto a nova tecnologia, pautado no diploma legal em que regula o comércio eletrónico em Portugal e na União Europeia, na qual o Smart Contract deve sujeitar-se, bem como demonstrar a sua formação contratual e todo o potencial que a nova tecnologia, Blockchain, pode fornecer para a atual sociedade. Em suma, o presente trabalho versa acerca de apresentar uma análise entre as vantagens e desvantagem desta nova modalidade de celebração de contrato, a apresentar aplicações práticas existentes em diversos países do mundo, e os novos desafios que irão surgir diante dos profissionais do direito, que para além das dúvidas já existentes, deverão solucionar questões inusitadas que jamais foram vistas antes.
