A subjectividade na tomada de decisão judicial

Abstract

Analisa-se até que ponto o acto de julgar pode ser visto como um acto individual, levado a cabo por um sujeito, situado num dado tempo e espaço, capaz de emitir juízos e valorações. Neste estudo, coloca-se em causa a discussão em torno da decisão judicial e da presença de subjectividade no acto de julgar, aquando da livre apreciação da prova. Através de uma abordagem jurídica, complementada pelos contributos dados pela Neurociência, acerca dos processos de tomada de decisão, procura-se compreender o papel desempenhado pela emoção na racionalidade de uma decisão. Considerou-se que essa decisão judicial pode ser a lei associada à vontade do juiz e, ainda assim, produto da racionalidade.
