Crime e castigo : no liberalismo em Portugal

Abstract

No Portugal do século XIX, os modos legítimos de punir surgiram como questão governativa de primeiro plano. Em nome de ideais de regeneração social, civilização e modernidade, foram importados modelos prisionais e desenvolvidas ciências para estudar o crime, o criminoso e o castigo. Instituições e saberes convergiram no sentido de dotar o país de um sistema penitenciário moderno, próprio do que se entendia ser uma nação «civilizada». Nas suas formas históricas, esse programa desenhou um trajecto de reformas - penais e prisionais - que, apesar da diversidade dos seus graus de aplicação, deixaram marcas na história portuguesa. Este livro trata precisamente dessas marcas, visíveis quer nos conceitos e formas de pensar o acto criminoso (a culpa, as causas do crime, a personalidade do delinquente) e o papel do Estado na construção da ordem social (as funções do castigo), quer nas modificações institucionais efectivamente produzidas. Nesse sentido, são observados os momentos cruciais da história penal oitocentista: do movimento de reforma das prisões, impulsionado pela revolução liberal de 1820, aos gorados projectos penitenciários das décadas de 1830 e 1840; do primeiro código penal português, em 1852, à abolição da pena de morte e simultânea criação do sistema penitenciário, em1867. Conclui-se com uma análise da difusão do positivismo jurídico e criminológico em Portugal, já na década de 1880.
