Patroni e liberti in Tac. Ann. 13,26-27

Abstract

In tempi recenti, fra gli studiosi di diritto romano si è riacceso un certo interesse sul tema della ingratitudine dei liberti nei confronti dei patroni e delle sue conseguenze giuridiche. Fra queste, in particolare, va ricordata la revocatio in servitutem del liberto ingrato, in seguito alla quale vi era la perdita della libertà. Su questa sanzione vi è un forte dibattito: mentre alcuni ritengono che sia stata introdotta in via generale solo a partire da Costantino, per altri le sue radici sono da ricondurre all’età classica. In tale quadro, l’articolo si prefgge lo scopo di approfondire un passo di Tacito, Ann. 13,26-27, dove si tratta proprio di una richiesta effettuata in Senato da parte dei patroni di poter ottenere il “diritto di revocare la libertà”. Nella ricostruzione degli eventi effettuata da Tacito, emergono alcuni indizi che permettono di avanzare alcune osservazioni sulla revoca della libertà, e sul suo rapporto con altre sanzioni previste per i comportamenti ingrati dei liberti.
