Abstract

Los tiempos que vivimos, alterados por conflictos infinitos, signan los contornos para una nueva área de debate sobre el sentido, sobre las razones del binomio guerra-paz y sobre las implicaciones jurídicas; en pocas palabras, sobre la proximidad del fenómeno de la paz a los derechos humanos. La guerra es ruptura y el orden jurídico que consigue asume las connotaciones políticas de un régimen legitimado a través del consenso del cual toma vida un gobierno, se activa el monopolio de la fuerza en las formas de la estatalidad. Pareciera indispensable poner en funcionamiento el posible inicio de un recorrido de liberación por la paz entendida como condición de posibilidad filosófica que sea plena de sentido en la superación de la vacía irrealidad del conflicto; en el hacer de una comprensión vital y, al mismo tiempo, programática; en el delinear los fundamentos culturales de una filosofía de la creatividad significativa. El método utilizado es el documental. Se concluye que la paz como inicio se desarrolla como fin y no como medio, como ya indicaba Aristóteles en la Política.

The times in which we live, altered by infinite conflicts, indicate the outlines for a new area of debate about meaning, the reasons for the war-peace binomial and legal implications; in a few words, about the proximity of the phenomenon of peace to human rights. War is rupture and the legal order that it obtains assumes the political connotations of a regime legitimated through the consensus from which a government takes its life; the monopoly off force is activated in the forms of statehood. It would seem indispensable to put into action the possible beginning of a route of liberation for peace, understood as a condition of philosophical possibility that is filled with meaning in overcoming the empty unreality of conflict; in making a vital and at the same time, programmatic understanding; in delineating cultural foundations for a philosophy of meaningful creativity. The method used is documentary. Conclusions are that peace as a beginning is developed as an end and not as a means, as Aristotle has already indicated in Politics.
