Abstract

La tutela dell’autodeterminazione in bio- medicina è un luogo critico del diritto privato , al crocevia tra visioni dell’autonomia (come fine in sé o come mezzo a fine), sistemi di responsabilità (civile, amministrativa, penale, disciplinare), pluralità degli ordinamenti (nazionali e transnazionali, pubblici e privati). L’attrazione dell’integrità psico-fisica nell’orbita dei diritti fondamentali ha scardinato il compromesso scritto nel raccordo tra condizioni di liceità penale della condotta e la regola civilistica di disponibilità limitata del corpo, ma un nuovo paradigma stenta a nascere. Il regime giuridico del consenso — rationes, presupposti soggettivi e oggettivi, raggio di applicazione, efficacia — è conteso tra finalità disparate: garantire diritti individuali, distribuire rischi professionali, preservare la fiducia nel rapporto terapeutico, tutelare l’interesse pubblico a esercitare un controllo su cure, dati, materiali biomedici. Ragioni istituzionali e culturali fanno sì che questa complessa matrice sia riflessa in modo parziale e distorto dal diritto privato. Questa voce inquadra i problemi etici e giuridici sollevati dall'autonomia del paziente nel contesto dell'emersione di un «mercato» delle cure e della crisi del welfare tradizionale e in una prospettiva di compatibilità tra sistemi di regolamentazione.
