Abstract

Epitome Athanasii 17.3 – sunto drastico di Nov. Iust. 121 del 535 in tema di pagamento d’interessi e di computo della usurae ultra duplum – reca una rubrica singolare, traducibile, alla lettera, con “rescritto interpretante il ‘rigonfiamento’ ("herpén") degli interessi”. Si condivide la vecchia opinione, minoritaria, che individua in "herpén" una rabberciatura del testo, ma se ne respingono i tentativi di emendazione, a causa della loro sostanziale atecnicità. Si propone di riconoscere nel termine rabberciato un fraintendimento, da parte del copista, della forma abbreviata di "eperotesin"= lat. stipulationem. Di conseguenza, il testo va così inteso: “rescritto interpretativo della stipulatio usurarum”. Attraverso l’esame di numerosi documenti della prassi negoziale e di alcune fonti bizantine su giuristi di età giustinianea s’intende argomentare l’intervento testuale e prevenire possibili obiezioni tanto di ordine paleografico, quanto di carattere giuridico-lessicale.
