Abstract

La consagración laical tiene un valor propio independientemente del ministerio sagrado. La presencia de miembros laicos junto a clérigos dentro de un instituto clerical plantea cuestiones jurídicas pendientes de clarificar relacionadas con la participación en el gobierno y la misión. Se discute la oportunidad de ser reconocidos como institutos clericales y se plantea la posibilidad normativa del reconocimiento como institutos mixtos para salvaguardar mejor la dignidad e identidad de sus miembros. Un instituto mixto sería aquel en el que en el proyecto original todos los miembros clérigos y no clérigos- son considerados iguales entre sí con igualdad de derechos y de obligaciones. Ni normativamente ni la praxis de la Santa Sede ha cambiado lo que establece el can. 588: los institutos son laicales o clericales. La demanda de una plena participación en el gobierno de los institutos por parte de los hermanos sólo encuentra respuesta en casos particulares que la autoridad suprema concede al aprobar las Constituciones: superiores locales, vicarios provinciales, miembros de consejos en todos los niveles. El complejo de facultades concedidas por el ordenamiento canónico a los Superiores mayores de los institutos clericales exige que el gobierno de estos institutos se confíe a los clérigos.
