Abstract

This work aims to present a range of understanding on the international regime of ethic in war, most specifically the ethics of jus in bello. Jus in bello refers to rules and codes of conduct that must be observed in the course of warfare and is mainly represented by the war conventions of Geneve and Hague. This modus operandi defines the way the combatents must act during confrontation. Nevertheless, the daily reality of war itself does not incline towards any cooperative system (which is a key concept in the theory of regimes) among enemy States. Thus, the work investigates the performance of the regime of ethic in war and inquires into the process of decision making by those involved in armed conflicts, fundamentally the one which concerns moderating the conduct of combatants. Furthermore, the relevance of moral factors and international regulation to overcoming those barriers intrinsic to war, such as aggressiveness, selfish posture and utilitarianism, in order to facilitate the respect for humanitarian principles.
