Abstract

İş ve aile sorumlulukları yetişkin hayatının önemli boyutlarını oluşturmakta olup iki sorumluluk arasındaki dengenin sağlanması demografik yapıda, aile yapısında, kültürde, istihdam piyasalarında ve işin doğasındaki dönüşüm sebebiyle daha da zorlaşmaktadır. Bu dengenin sağlanamaması aile ile ilgili, iş ile ilgili ve sağlıkla ilgili sonuçlar doğurmaktadır. Bu kapsamda geliştirilecek aile dostu iş hukuku uygulamaları hukukun zorlayıcı yapısı sayesinde eşit olmayanlar arası ilişkilerin düzenlenmesinde etkili bir araç olabilecektir. Bu kapsamda esnek istihdam biçimlerine, izin düzenlemelerine ve bağımlı bakımı düzenlemelerine başvurulmaktadır.Bu çalışmanın amacı; iş ve ailedeki değişimleri göz önünde bulundurarak aile dostu iş hukuku uygulamalarının ortaya konması ve bu kapsamda Türk İş Hukuku’ndaki aile dostu uygulamaların uluslararası iş hukuku kaynakları ve bazı yabancı ülke hukuklarındaki düzenlemeler kapsamında incelenmesidir. Bu çerçevede iş hukuku düzenlemelerinin aile söz konusu olduğunda asgari standartların üzerini hedeflemesi, toplumsal cinsiyet kalıplarını pekiştirebilecek uygulamalardan uzaklaşılması, güvenceli esneklik uygulamalarının güvence boyutunun daha fazla desteklenmesi, izin düzenlemelerinde her iki ebeveynin de göz önünde bulundurulması ve bağımlı bakımına yönelik bakım hizmetleri ve bakım sübvansiyonlarının sunulmasına ihtiyaç olduğu ileri sürülmektedir.

Work and family responsibilities constitute essential dimensions of adult life. Supporting the balance between these two responsibilities becomes more difficult due to the shift in demographic structure, family structure, culture, employment markets, and nature of work. Failure to achieve this balance has consequences for family, work and health. In this context, developing family-friendly labour law practices will be an effective tool in regulating unequal relations because of the law’s coercive nature. Flexible employment forms, leave arrangements, and dependent care structures are adopted within this scope.This study aims to reveal family-friendly labour law practices considering the changes in work and family and to examine the family-friendly practices in Turkish Labor Law with International Labour Law and Foreign Laws. In this context, the following is suggested; There is a need for labour law regulations to target above minimum standards when it comes to family, to move away from practices that can reinforce gender stereotypes, to support the security aspect of flexicurity practices more, to consider both parents in leave arrangements, and to provide care services and care allowances for dependent care.
