Karâfî’den Şâtıbî’ye makâsıd/maslahat söylemi

Abstract

Öz: Cüveynî tarafından sistematik bir mahiyette ele alınan makâsıd/maslahat konusu İbn Abdüsselâm tarafından müstakil bir kitap halinde genişçe ele alınır. İbn Abdüsselâm’ın konuyu ge- nişleten bu çalışması onu yeni haliyle tekrar sistematik bir noktaya ircâ etme ihtiyacı doğurmuştur. Karâfî, hocası İbn Abdüsselâm’dan sonra konuyu âdeta yeniden sistematik bir zeminde ele alan bir ilim adamıdır. İslâm Hukukçularının konuya ilgisi her zaman devam etmiştir. Bu makalede Karâfî ve ondan sonra yaşamış önemli İslam Hukukçularının maslahat konusuna yaklaşımları ele alına- caktır. Bunlar arasında Tûfî’nin özel bir yeri vardır. Tûfî’nin iddia edildiği gibi maslahatı nasların önüne geçirip geçirmediği ve onun bunu çağrıştıran bazı cümlelerinin konu bütünlüğü içinde nasıl anlaşılması gerektiği açıklığa kavuşturulmaya çalışılacaktır. Ayrıca eserlerinde maslahatı sık sık re- ferans gösteren İbn Teymiye ve İbn Kayyim el-Cevziyye ile usulcü ve fıkıhçı Tâcüddîn es-Sübkî de Şâtıbî öncesinde görüşlerini ele aldığımız âlimler arasında yer alacaktır.

Abstract: Ibn Abd al-Salâm broadly wrote Maslaha in his separate book, which this topic had systematically been studied by Juwaynî. When Ibn Abd al-Salâm enlarged the topic, scholars need to rearrange it to its systematic way. Qarâfî, one of the students of Ibn Abd al-Salam is someone who rewrote systematically this topic. Scholars in the area of Jurisprudence always pay attention to it. In this article I shell focus on approaches of scholars lived after Qarâfî about Maslaha. Among them, Tûfî has a distinguished place. So I shell try to explain whether or not Tûfî prefered Maslaha over Nass and to understand some his words impliying the preference in its content integrity. Ibn Taymiyya referrign frequently to Maslaha, Ibn Qayyim al-Jawziyya and Taj al-Din al-Subkî also are among the scholars i will study their approaches.
