Abstract

Yasa koyucunun 4721 sayılı TMK m. 535'e getirdiği değişiklikteki amacı, iki türlü olan resmi vasiyetnamelerin, vasiyetçinin okuma yazma iktidarı bulunup bulunmamasına göre düzenleme alanı bulacağını belirtmek, bu yönde net/tartışmaya mahal vermeyecek bir düzenleme yapmaktır. Değişiklikteki kanun maddesi başlığı ve kanun maddesi içeriği, iki türlü düzenlenen resmi vasiyetnameyi birbirinden açık bir şekilde ayırmakla birlikte, "okuma yazma" kıstasını ele alarak, kimlerin hangi resmi vasiyetnameyi düzenlemesi gerektiğini ortaya koymaktadır. Böylelikle yeni yasa metni, yasanın konuluş amacına ve ruhuna uygun bir hal almıştır. TMK m. 535, özüyle ve sözüyle, yasa koyucunun gerçek amacını ortaya koymakta, iki türe ayrılan resmi vasiyetnamenin şeklini okuma yazma kriterine göre kesin olarak ayırma fonksiyonuna sahiptir. Bu ayırım, okuma yazma iktidarına sahip bir kimseyi, dilediği resmi vasiyetname türünü seçerek, vasiyetname düzenleme/düzenlettirme hak ve yetkisi vermemektedir. Bu kapsamda her okuma yazma bilen kişinin "seçimlik hak" şeklinde dilerse Medeni Kanun madde 534 dilerse Medeni Kanun madde 535'e göre vasiyetname düzenleyebileceğini kabul etmek mümkün olmayacaktır

The purpose of alteration numbered 4721 TMK (Turkish Civil Code) provision 535 is to indicate arrangement area between two kinds of official will according to presence or absence of reading/writing ability. The title and the content of this provision separate two kinds of official will from each other and considers the criteria of reading/writing. In addition, it reveals who regulate which official will. Accordingly, this provision is compatible with the purpose and the spirit of statute. However, this distinction does not mean that a person who has an ability to read/write might choose the kind of official will which he wants. As a result, each person who has an ability to read/write is not entitled to have a right of choice between TMK (Turkish Civil Code) provision 534 and provision 535
