It is known that searching which is one of the protection precautions that are appliedthe most after catching criminal judgment law and which has a close connection with humanrights is appealed to in practice very often. Therefore human rights mustn?t be violated in noway and justice and safety must be obtained regularly and continuously.In the first part of this study, judicial searching ?as a concept- , legal quality of it , thehistory of it , the principals of it , subjects of judicial searching in international documents arebeing discussed.In the second part, the types of searching ?judicial searching and preventionsearching- are being discussed.In the third part, the aims and the conditions of preventive measures of searching arebeing stated.In the fourth part, some situations which are not searching in fact, the question of`secret pursuing? ? is it searching or not? - The inspection of the place of event are beingstated.In the fifth part, under the main and basic title of execution of searching theymentioned about the people who can search, giving information to the person who will beunder searching, witnesses in the searching, being able to get help from the lawyer whilesearching is happening, the discipline of searching and the power of using force, the processesthat will be made about the witnesses and clues which were obtained during the searching, theprocedures will be followed about the goods and papers which were held in the searching andthe procedures will be followed about the evidences which were held randomly.In the sixth part, searching report and its content, the report which will be given at theand of the searching, the report gained from the searching and the license /authority toexamine the papers are described under the title of `The End of the Searching.?In the seventh part, searching which is contrary to law with regard to criminal trial andcriminal law, legal control and compensation points are mentioned.

Bu sebeple insan haklarının hiç bir sekildeihlal edilmemesi, adaletin ve güvenligin düzenli ve sürekli olarak saglanması gerekmektedir.Bu çalısmamızın birinci bölümünde arama kavramı, adli aramanın hukuki niteligi,adli aramanın tarihçesi, adli aramaya hâkim olan ilkeler, uluslar arası belgelerde adli aramakonuları islenmistir.kinci bölümünde arama çesitleri olarak adli arama ve önleme araması konularıüzerinde durulmustur.Üçüncü bölümünde arama koruma tedbirinin amacı ve sartları anlatılmıstır.Dördüncü bölümünde arama sayılmayan haller, gizli izlemenin ?arama? olupolmadıgı sorunu, olay yeri inceleme konuları anlatılmıstır.Besinci bölümünde aramanın icrası ana baslıgı altında arama yapabilecek kisiler,aramaya maruz kalacak kisiye bilgi verilmesi, aramada hazır bulunabilecek kisiler, arama( islem ) tanıkları, aramada avukat yardımından yararlanabilme, aramanın inzibatı ve zorkullanma yetkisi, arama sırasında ele geçen kisi ve deliller hakkında yapılacak islemler, aramasırasında ele geçen esya ve kâgıt hakkında yapılacak islemler, tesadüfen ele geçen delillerhakkında yapılacak islemler konuları üzerinde durulmustur.Altıncı bölümde aramanın sona ermesi ana baslıgı altında arama tutanagı ve içerigi,arama sonunda verilecek belge, aramada elde edilen belge ve kâgıtları inceleme yetkisikonuları anlatılmıstır.Yedinci bölümde ceza muhakemesi ve ceza hukuku bakımından hukuka aykırıarama, hukuki denetim, tazminat konuları üzerinde durulmustur.
