Eşlerin çocuk üzerindeki velayet hakkı

Abstract

Family, Previously ruled completely by the father, forming a wide structureincluding the children of the children, today means a unity formed of mother, father and child,which we call the core family. A parental right is a double way concept, expressing therelations between the children and their parents, including the rights and obligate.Changing its concept considerably by time, parental rights used to be known as aright granted to the father not only on the children but on the whole members on the family;then became a right which was also granted to the mother. As the position of children wasconsidered more important socially, the absoluteness nature right in question became weakerand the parental rights institution had been established by adding some responsibilities. Now,as generally accepted, parental rights are first there for the child. Nevertheless, they are therights of the parents which are originated by the Constitution. The rights in question are seenin many areas from the religion education of the child to spending the properties of the child.The limits of all these rights which the parents have on their children are also drawn by laws.As parental rights are a sum of certain rights and obligations of the parents on thechild and his/her properties, the section of the parental rights which only include the rights isthe subject matter of our thesis. The subject matter of the parental rights of spouses onchildren is essentially discussed on the context of Family Law.

Toplumun temelini olusturan aile, önceleri tamamen babanın egemen oldugu veçocukların çocuklarını da kapsayan oldukça genis bir yapıyı karsılarken, günümüzde çekirdekaile de dedigimiz ana, baba ve çocuktan meydana gelen birligi ifade eder olmustur. Çocuklarile ana ve babaları arasındaki iliskileri ifade eden velayet, haklar ve yükümlülükleri kapsayançift yönlü bir kavramdır.Zaman içerisinde kavramsal olarak oldukça degisen velayet hakkı, Roma Hukukudöneminde sadece çocuklar üzerinde degil, ailenin tüm bireyleri üzerinde mutlak olarakbabaya verilmis bir hak olarak karsımıza çıkarken; daha sonraları anaya da tanınan bir hakolmustur. Çocukların toplumdaki yerinin önemsenmesiyle birlikte söz konusu hakkınmutlaklık özelligi zayıflamıs, birtakım ödevler de eklenerek velayet kurumu olusmustur. Artıkvelayet, genellikle kabul gördügü üzere, önce çocuk için vardır. Bununla birlikte ana vebabanın kaynagını Anayasa'dan alan hakkıdır. Söz konusu hak, çocugun din egitimindenmallarının sarf edilmesine kadar pek çok alanda karsımıza çıkar. Ana ve babanın, çocuklarıüzerinde sahip oldukları tüm bu hakların sınırları da kanunlarla çizilmistir.Ana ve babanın, çocugun kendisi ve malları üzerinde sahip oldugu birtakım haklar veyükümlülükler toplamı olan velayetin, yalnızca hakları kapsayan kısmı tezimizin de konusunuolusturmaktadır. Eslerin çocuk üzerindeki velayet hakkı konusu, asıl olarak Aile Hukukubaglamında ele alınmaktadır.
