Abstract

KENDİ KADERİNİ TAYİN ETME KAVRAMI VE NAGORNO KARABAĞ KONFLİKTİ Kendi Kaderini Tayin Etme kavramı onsekizinci yüzyılın en önemli çıktılarından olmuştur. Kavram günümüze kadar çok yol katetmiş ve uluslararası hukukun temel prensibi haline gelmiştir. Dünyanın her yanında Kendi Kaderini Tayin Etme istekleri yükselmektedir. Bir taraftan kavramın, bütün halkların Kendi Kaderini Tayini Hakkı olarak pekişip pekişmediği tartışması geçerliliğini korumaktadır. Diğer taraftan bazı yazarlar bu hakkı sömürge sonrası dönemde otonomi ve halkların kendilerini yönetmesi olarak değerlendirmeye çalışmaktadırlar. Bu çalışma ile Kendi Kaderini Tayin Etme kavramının gelişim süreci ve uluslararası hukukun temel prensip ve hakları ile ilişkisi anlatılmaya çalışılmıştır. Aynı zamanda Nagorno Karabağ Konflikti Kendi Kaderini Tayin Etme bağlamında ele alınmıştır. Halkların Kendi Kaderini Tayin Etme kavramının temel hak olarak geliştiği görülmektedir. Azınlıklar nüfusu oluşturan çoğunlukla birlikte Kendi Kaderini Tayin Hakkına haizdirler. Azınlık Haklarının ihlali, azınlıklara karşı güçlü ayrımcılık ve demokratik olmayan sistemler, azınlıkların Kendi Kaderini Tayin Hakkını ileri sürmeleri için neden oluşturmaktadırlar. Nagorno Karabağ Konfliktinin tarihsel gelişiminin ve daha da önemlisi mevcut devletten ayrılmak anlamında Kendi Kaderini Tayin Hakkını uygulamak yolunda Nagorno Karabağ ve Ermenistan'ın öne sürmeye çalıştığı hukuksal faktörlerin incelenmesi, Nagorno Karabağ'ın bu hakkı öne sürdüğü bağlamda kullanamayacağını göstermektedir.

THE CONCEPT OF SELF-DETERMINATION AND THE CONFLICT OF NAGORNO KARABAKH The concept of self-determination was one of the major outputs of the eighteenth century. It traveled long way till today and was established as a fundamental principle in international law. Claims of self-determination of peoples extent along the world. On the one hand debates of whether the concept evolved to the legal right that entitles all peoples to self-determination, are keeping its validation. On the other hand some writers attempt to regard the self-determination as a right to autonomy and self-government of the peoples in the post-colonial era. With this study the process of development of the self-determination and its relations with some fundamental principles and rights in international law are explained. At the same time, the conflict of Nagorno Karabakh is investigated in respect of self-determination. It seems the concept of self-determination exists as ongoing right of all peoples. Minorities implement the right of self-determination together with majority of population. Denial of minority rights, strong discrimination against minority and undemocratic systems are causes for self-determination claims. Study of the historical context of the Nagorno Karabakh conflict and more importantly, legal factors that Nagorno Karabakh and Armenia are presenting to justify implemention of self-determination in a sense of secession shows that Nagorno Karabakh fails utilize this right.
