Abstract

LAWSUITS FOR CLOSING DOWNPOLITICAL PARTIES IN TURKEY The thesis consisted of four parts. The first part of our thesis consisted of the description of political party, its elements, its historical development and its place in the laws of various countries. In the second part, closure system of political parties is dealt with. First of all, prohibition of political parties among the world, background of this, closure criteria in national and international law systems are analyzed. In this regard, the laws decisions related to political parties in our country, criteria in different constitutions and political party rules, method of closure lawsuits for political parties, are mentioned. In the third part, decision summaries of lawsuits of political parties closed by Constitutional Court in Turkey is presented. In addition, decision summaries of lawsuits of parties closed by National Security Council and lawsuits of parties sued to Constitutional Court but not closed are presented. In the fourth, part the matters, which are accepted as criteria for closure decision by Constitutional Court are presented.

Tez dört ana bölümden oluşmaktadır. Tezimizin birinci bölümünü siyasi partinin tanımı, unsurları, tarihsel gelişimi ve değişik ülke mevzuatlarındaki yeri oluşturmaktadır. İkinci bölümde, siyasi partilerin kapatılması rejimi ele alınmıştır. Öncelikle dünyada siyasi parti yasaklamaları ve bunun arka planı, uluslararası hukukta ve ulusal hukuk sistemlerinde kapatma kriterleri incelenmiştir. Buradan ülkemizde siyasi partilerle ilgili mevzuat hükümleri, değişik anayasalarda ve siyasi parti yasalarında yer alan kriterle ile siyasi parti kapatma davalarının usulü anlatılmıştır. Üçüncü bölümde Türkiye'de Anayasa Mahkemesi tarafından kapatılan davaların karar özetleri yer almaktadır. Ayrıca, Milli Güvenlik Konseyi tarafından kapatılan partilerle, Anayasa Mahkemesine kapatma davası açılan ancak, kapatma kararı verilmeyen partilerin davalarının karar özetleri de sunulmuştur. Dördüncü bölümde ise Anayasa Mahkemesinin kapatma kararlarına kriter olarak kabul ettiği hususlar yer almıştır.
