Abstract

Çalışmamızın Milletlerarası Hukukta Azınlıkların Korunmasının Tarihi Gelişimi isimli 1. bölümünde, gittikçe artan öneme sahip olmaya başlayan azınlık haklarının tarihi gelişim süreci incelendi. Öncelikle azınlık kavramını ele alındı. Daha sonra tarihi süreç, Milletler Cemiyeti'ne Kadar Olan Dönem, Milletler Cemiyeti Dönemi ve Milletler Cemiyeti Sonrası Dönem şeklinde dönemlere göre incelendi. Tezimizin Orta Asya Türk Cumhuriyetlerinde Azınlıklar Meselesi isimli 2. bölümünde bu Cumhuriyetler eski SSCB ülkeleri olduğu için SSCB'nin azınlıklar ve milliyetler politikasına değinildi. Bu bölümde SSCB Dönemindeki Durum ve SSCB Dağılırken ortaya çıkan gelişmeler ele alındı. SSCB Sonrası Cumhuriyetlerdeki Durumu anlatılırken Azerbaycan, Kazakistan, Kırgızistan ve Özbekistan'daki azınlık meseleleri ele alındı. Cumhuriyetlerde azınlıklarla ilgili özellikle anayasal düzeydeki hukuki düzenlemeler de incelendi. Ayrıca Azerbaycan ele alınırken Dağlık Karabağ, Özbekistan ele alınırken de Karakalpakistan Muhtar Cumhuriyeti meseleleri de incelendi. Bir Milletlerarası Hukuk Sorunu Olarak Türkmenistan'daki Azınlıkların Hukuki Durumu başlıklı 3. bölümde Türkmenistan'daki azınlıkların hukuki ve fiili durumları incelendi. Hukuki durum incelenirken Türkmenistan'ın azınlıklarla ilgili milli ve milletlerarası hukuki metinleri değerlendirildi. Azınlıklarla ilgili fiili durumda ise Türkmenistan'da eğitim, din, kültür ve dil, siyasal hayat ile ilgili uygulamalar ele alındı.

In my study, I studied at historical development movement of minority rights in Chapter 1 which name is Historical Development of Protection of Minorities in International Law. Firstly I explained concept of minority. After I exemine historical period about minorities in three period: Before League of Nations, The Priod of League of Nations and After League of Nations. In Chapter 2 which name is Minorities Problem in Central Asian Turkic Republics I examined minority and nationality policy of former USSR. Because these Republics were former USSR countries (Azerbaijan, Kazakhstan, Kyrgyzstan and Uzbekistan). This chapter have that topic: USSR Period, Collapse Period and The Republics After the Collapse of USSR. I examined minority problems in these republics in terms of basic legal documents and cases. For Azerbaican I examine Nogorno-Karabagh issue and for Uzbekistan I examine Karakalpak Autonomic Republic. I studied at de facto and de jure conditions of minorities in Turkmenistan in Chapter 3 which name is Legal Position of Minorities in Turkmenistan as an International Law Issue. For this I examine internal and international law document of Turkmenistan. And then I examine de facto conditions of minorities in terms of religion, culture, politics, education and language.
