Abstract

The main objective of this study is to try to explain `the law of legality of taxes` in accordance with decisions of The Constitutional Court, which has been regulated under the title of `Tax Obligation` in 73th article of 1982 Constitution. Tax-raising power which is possessed by the goverment and which is the most forceful interference with the individual rights and freedoms is limited with The Law of Legality of Taxes and prevents arbitrary implementations.The concept of tax-raising power, its content and historical development have been mentioned in the study with the aim of better intelligibility of the Law of Legality and provisions in the national and supranational scopes have been clarified respectively. Article 73 of the Constitution is explained in detail and the exceptions to the principle of legality of taxes are mentioned. In the Constitution, the powers given to the executive organ are tried to be explained within the framework of the relevant articles.Related topics have been supported in the whole study eith the decisions of Constitutional Court and the notions of the high court have been discussed.

Çalışmanın temel amacı, 1982 Anayasası'nın 73'üncü maddesinde `Vergi Ödevi` başlığı altında düzenlenen `vergilerin kanuniliği ilkesi`ni Anayasa Mahkemesi kararları doğrultusunda açıklamaya çalışmaktır. Devletin elinde bulundurduğu ve kişilerin hak ve özgürlüklerine yapılan en etkin müdahalelerden olan vergilendirme yetkisi, vergilerin kanuniliği ilkesi ile sınırlandırılmakta ve keyfiyete dayalı uygulamaları önlemektedir. Kanunilik ilkesinin daha iyi anlaşılması amacıyla çalışmada vergilendirme yetkisi kavramı, kapsamı ve yetkinin tarihsel gelişiminden bahsedilmiş, ulusal ve uluslar üstü alanlardaki hükümleri sırası ile açıklanmıştır. Anayasa'nın 73'üncü maddesi ayrıntılı olarak açıklanmış ve vergilerin kanuniliği ilkesinin istisnalarından bahsedilmiştir. Anayasa'da yürütme organına verilen yetkiler ilgili maddeler çerçevesinde açıklanmaya çalışılmıştır.Çalışmanın tamamında Anayasa Mahkemesi kararlarına oldukça yer verilmiş ve ilgili konularda yüksek mahkeme tarafından belirtilen görüşler tartışılmıştır.
