Abstract

Bu araştırmada Mekke ve Medine Haremi ve bu alanlarla ilgili hükümler İslam Hukuku açısından ele alınıp değerlendirilmektedir. Bu çalışmada `Harem` kavramı belirleyici unsur olmuştur. Çalışmada bir yerin harem olması ile kastedilenin ne olduğu, onu diğer yerlerden ayırt edici yönleri, onun bünyesinden sayılan unsurları, harem olarak nitelendirilen yerlerin, insan hayatına pratikte etkileri vb. hususlar ele alınmıştır. Araştırmada Mekke ve Medine şehirleri bu hususiyet açısından değerlendirilmiştir. Harem kelimesi harâm ile eş anlamlıdır. Harem, Mekke'nin sınırları belirleyen dikili taşlara kadar olan çevresi ile Medine'nin etrafında sınırları Hz. Muhammed (s.a.v.) tarafından belirlenmiş alanı ifade eder. Mekke'nin mukaddes çevresinin sınırları tespit edilmiş ve buralara işaretler konulmuştur. Harem içerisinde uyulması gereken kurallar ve bazı yasaklar vardır. Bu özel hükümler sebebiyle bölgeye `Harem` adı verilmiştir. İnsanlık tarihi boyunca, yüklenen değer açısından bazı coğrafî yer ya da mekânlar kutsal olarak kabul edilmiş ve ayrı bir statüye konulmaktadır. İslâm dininin inanç esaslarına göre bir mekâna, bir zamana kutsallık atfedilmesi Allah'ın iradesiyle olur ve O'nun bildirmesiyle bilinir. Kur'an'da Kâbe'nin haram, saygıya layık bir yer olduğu, Kâbe çevresindeki Mescid ve Mekke şehrinin de haram, dokunulmaz olduğu belirtilmiştir. Hz. Peygamber, Mekke'nin fethinde, bu şehri Allah'ın haram kıldığını bildirmiştir. Mekke, Kâbe'nin inşasından itibaren `harem` kabul edilirken, Medine hicretten sonra Hz. Peygamber (s.a.s.) tarafından harem ilan edilmiştir.Anahtar Kelimeler : Mekke, Medine, Harem

In this research, Makkah and Medina Haram and the rules related to these areas are evaluated and evaluated in terms of Islamic Law. In this study, the concept of `Harem` became the decisive factor. What does it mean to be a place of harem; What are the characteristics of the harem different from other places; What are its self-rated elements; Harem, holy places, what are the effects on human life in practice … topich such as examined. Holy haram of Makkah and Medina was evaluated in the survey. Harem word means haram. The harem is surrounded by signs that mark holy borders of Makkah and The harem refers to the holy area around Medina, whose borders are determined by the Prophet Muhammad of Islam. The holy borders of Makkah were identified and stones pointing to these borders were placed. There are rules to be followed in the harem and prohibitions to be avoided. This area is called `Harem` because of special rules and prohibitions. Throughout the history of human, some geographical places or special places are regarded as holy. According to the principles of belief of the Islamic religion, the attribution of a place, holiness, is by Allah's will and is known by Allah's declaration. The Kaaba in the Qur'an is haram, a place worthy of respect, Masjid in the vicinity of the Kaaba and the city of Makkah a also haram, untouchable. The Prophet, on the day of Makkah's conquest, declared that this city was a city with Allah's blessed. While Makkah was accepted as `harem` from the Kaaba's construction, The Medina was reported as a harem by the Prophet after the migration.Keywords :Makkah, Medina, Haram
