Abstract

This thesis examines objection as a regal remedy, which is regulated in 267th and following Articles of Turkish Criminal Procedure Code. Objection can be filed to judge decisions before judgment and during criminal procedure transactions and also to court decisions if specified by the Code. This thesis is consisted of three parts. In the first part examines the notion of legal remedy, subject, types and aim of the legal remedies, the relationship among legal remedies, independence of judges and right to a fair trial, and besides mentions historical evolution of legal remedies. The second part explains the notion of objection and the decisions of judge and court that subject to objection. The third part touches upon filing procedure of objection, persons, have right to file an objection, competent objection authorities, competent authorities' examination upon an objection, whether principle of reformatio in peius can be applied in objection and the examinability of decisions given upon objection.Keywords: Objection as a regal remedy, right to file an objection, criminal judgeship(judgeship functions in the investigation process), pre-judgment precautions.

Üç bölümden oluşan bu tezde, Ceza Muhakemesi Kanunu'nun 267 ve devamı maddelerinde düzenlenen, ceza muhakemesi faaliyetleri sırasında ve hükümden önce verilen hâkim kararları ile kanunda gösterilen hallerde mahkemelerin ara kararlarının denetimi için öngörülen itiraz kanun yolu ele alınmıştır. Çalışmamızın ilk bölümünde kanun yolu kavramı, kanun yollarının konusu, çeşitleri, amacı, hâkimin bağımsızlığı ve adil yargılanma hakkı ile ilişkisi incelenmiş olup ayrıca kanun yollarının tarihsel gelişimine değinilmiştir. İkinci bölümde, itiraz kanun yolu kavramı ile itiraz kanun yoluna konu olabilecek hâkim ve CMK'da öngörülen itiraz kanun yoluna konu mahkeme kararları ile ilgili açıklamalarda bulunulmuştur. Üçüncü bölümde ise ana hatları ile temel olarak itiraz kanun yoluna başvuru usulü, itiraz kanun yoluna başvurabilecek kişiler, itiraz merciileri, itiraz üzerine merciinin nasıl inceleme yapacağı, itiraz kanun yolunda aleyhe değiştirme yasağının bulunup bulunmadığı ve itiraz kanun yolu neticesinde verilen kararın denetlenebilirliği konuları incelenmiştir.Anahtar Kelimeler: İtiraz kanun yolu, başvuru hakkı, sulh ceza hâkimliği, korumatedbirleri.
