Abstract

ÖZETİslam hukukunda genel bir prensip olarak konusu mevcut olmayan bir akit sahih değildir. Fakat selem konusu mevcut olmayan bir akidin yapılamıyacağı şeklindeki İslam hukuku kuralına istisna olarak Şerîat’ta caiz kılınmıştır. Bu nedenle de bu akdin sahih olması için bir takım özel şartlarının bulunması gerekmektedir.“Tûsî ve Serahsî’nin el-Mebsût’ları Örneğinde Ca‘ferî ve Hanefî Mezheplerine Göre Selem Akdi” adlı bu çalışmamızda insanların ihtiyaçlarına binaen caiz kılınan selem akdi bu iki mezhebin görüşleri görüşleri doğrultusunda incelenmeğe tabi tutulmuştur.Tezimiz giriş kısmı ve üç bölümden oluşmaktadır. Giriş kısmında araştırmanın önemi, amacı, yöntem ve kaynakları gibi başlıklar kısaca ele alınmıştır. Birinci bölümde Tûsî (ö. 460/1067) ve Serahsî (ö. 483/1090)’nin adı, nesebi, hayatı, tahsili, eserleri ve yaşadıkları dönem gibi başlıkları incelenmeğe çalıştık.İkinci bölümde genel bey‘ (satım) akdi ve bu akdin bir alt türünü oluşturan selem akdi hakkında genel bilgiler verilmiştir.Araştırmamızın son bölümünü oluşturan üçüncü bölümde ise Tûsî ve Serahsî’nin el-Mebsût adlı eserleri örneğinde Ca‘ferî ve Hanefî mezheplerinin selem muamelesi ile ilgili görüşlerine yer verilmiş ve bazı değerlendirmelerde bulunulmuştur. Daha sonra ise sonuç kısmı ve kullanılan kaynakların listesi verilerek araştırma tamamlanmıştır.ABSTRACTAs a general principle in Islamic Law a contract with non-existing subject is not authentic. But Salam was rendered permissible in Sharia as an exception to the above-mentioned rule. Therefore, it must have a number of special circumstances for the contract to be authentic.In this study named “Salam Contract in Hanafi and Jafari schools of Law with special reference to Tusi and Sarakhsi” the contract of Salam that was rendered permissible by the virtue of needs of people, were subjected to analyze through the opinion of these two Sects (Mazhabs).Our thesis is composed of Introduction section and three sections. In the Introduction part the topics such as the importance of the research, the purpose of the research, methods and resources are briefly discussed. In the first chapter we tried to research the names, ancestries, educations, works and the period of time life of Tusi and Sarakhsi.In the second chapter it is given general information about Bey Akdi (Sales Contract), and about Salam Contract - a sub-type of this contract.In the third chapter which is forming the last part of our study it was gives opinions of Jaferi and Hanafi sects related to salam transactions in the case of works of Tusi and Sarakhsi named ‘Al-Mabsout’ and was made some assessments. At the end it was given a conclusion and a list of used recourses, and the study was ended.
